NOTICE OF APPEAL
TO THE HONORABLE COURT AND ALL PARTIES OF RECORD:
Plaintiff Vertex Solutions LLC ("Appellant") hereby gives notice of appeal from the Final Judgment signed on April 1, 2026, in the above-styled and numbered cause.
1. Judgment Appealed
Appellant appeals from the Final Judgment signed by the Honorable Patricia Sandoval on April 1, 2026, which:
- Awarded Defendant GreenLeaf Technologies, Inc. $95,000.00 in actual damages on its counterclaims;
- Awarded Defendant prejudgment interest in the amount of $637.67;
- Awarded Defendant attorneys' fees in the amount of $31,350.00;
- Ordered Plaintiff to take nothing on its claims; and
- Assessed all costs against Plaintiff.
2. Appellate Court
This appeal is taken to the Third Court of Appeals, Austin, Texas.

5. Issues for Appeal

Issue 3: Whether the trial court erred in its interpretation of the contract term "acceptable industry tolerances" as presenting a fact question for the jury rather than a question of law for the court.
Issue 4: Whether the damages awarded to GreenLeaf Technologies, Inc. were supported by legally sufficient evidence.
6. Supersedeas
